Mobile Terms of Service

By consenting to receive SMS messages from Tears of the Left LLC during checkout or by subscribing through any of our opt-in tools, you agree to receive recurring text notifications to your mobile device regarding your order (including abandoned checkout reminders), promotional text messages, and transactional messages such as review requests — even if your number is listed on a federal or state Do-Not-Call registry. Consent is obtained only through an active opt-in, and you may withdraw your consent at any time by following the instructions in Section 3 (“Opt-Out Instructions”) below. Message frequency varies. Consent is not a condition of purchase.

1. Age & Alcohol-Related Compliance (21+ Requirement)

Because Tears of the Left LLC sells alcoholic products, you acknowledge and agree to the following:

• You must be 21 years of age or older to opt in to our SMS marketing program.
• By subscribing, you certify that you are 21+ and legally permitted to receive promotions for alcoholic beverages in your jurisdiction.
• You agree not to forward, share, or otherwise distribute SMS alcohol-related marketing messages to anyone under the age of 21.
• If at any time we have reason to believe you are under 21, we may suspend or terminate your SMS subscription.

Some states have additional restrictions on alcohol advertising. By opting in, you acknowledge that SMS messages may not be sent to you if prohibited by state law at any time.

2. Content of Messages – Alcohol Promotional Disclosures

SMS messages may include promotions for alcoholic beverages. By subscribing, you understand:

• SMS Messages may contain offers, release announcements, reminders, or product education relating to bourbon or other alcohol products. Information about the alcohol content of each product is provided on the label. 
• Please drink responsibly. Tears of the Left LLC promotes responsible alcohol consumption and does not encourage excessive or underage drinking.
• No SMS message constitutes medical, legal, or safety advice related to alcohol consumption.

3. Opt-Out Instructions

If you wish to unsubscribe from receiving SMS messages or notifications:

• Reply STOP to any SMS message from us, or
• Use the unsubscribe link provided in an SMS message, if unsubscribe link is provided.

Alternative opt-out phrasing (e.g., “end,” “cancel,” “unsubscribe,” or conversational requests) is not considered a valid opt-out method. You will receive a confirmation text once your request has been processed.

4. Message & Data Rates

Tears of the Left LLC does not charge for SMS messages, but **your carrier's message and data rates may apply**. You are responsible for all charges imposed by your wireless provider. Opting out does not incur a penalty, aside from standard carrier messaging rates that may apply.

We may change the phone number, long code, or short code we use to provide the SMS messages. If so, we will provide notice. Messages you send to a previous number may not be received.

6. Delivery, Liability & Service Limitations

To the extent permitted by law, you agree:

• Tears of the Left LLC is not liable for delayed, misdirected, or undelivered messages.
• You understand that network or carrier errors are outside of our control.
• We may suspend or terminate the service at any time for compliance, safety, or operational reasons.

This does not affect your statutory rights.

7. Privacy & Data Usage

Your privacy matters. We process your personal information in accordance with our Privacy Policy. This includes:

• data required for order notifications,
• data required to verify age and eligibility for alcohol-related messaging, and
• your rights to access, deletion, data portability, and withdrawal of consent.

8. Prohibited Uses

By subscribing to SMS messages from Tears of the Left LLC, you agree not to:

• subscribe if you are under 21,
• use SMS content to promote irresponsible or unsafe alcohol consumption, subscribe using automated tools, bots, or false information, and
• violate any applicable state or federal laws restricting alcohol advertising or SMS marketing.

We reserve the right to suspend or terminate your participation for any suspected misuse or noncompliance.

9. Regulatory Compliance With U.S. Laws

Our SMS program is designed to comply with:

• Telephone Consumer Protection Act (TCPA),
• CTIA Messaging Principles & Best Practices,
• FCC regulations for wireless communications,
• Federal and state regulations regarding the marketing of alcoholic beverages, including age restrictions, responsible consumption guidelines, and state-specific advertising limitations, and
• Carrier requirements for SMS marketing of alcohol, which require explicit 21+ age verification and responsible-drinking messaging.

Your participation confirms your understanding and acceptance of these compliance requirements.
